What We Do
The Office of Administrative Hearings (OAH) schedules, coordinates, and manages cases through the hearing process. The hearing process is two steps: 1) Virtual Pre-Hearing Conference and 2) Virtual Hearing. During the hearing process, a Hearing Officer provides information, listens to testimony from parties and witnesses, and evaluates evidence to issue a written decision based on the facts and applicable standards.
Our goal is to make sure proceedings are handled fairly, consistently, and according to University policies and procedures.
In All Cases We:
- Coordinate and schedule virtual proceedings with participants
- Provide information about the administrative hearing process
- Offer UNM Advisors to assist participants (not applicable for Employee Appeals)
- Conduct live virtual proceedings
- Issue written determinations
- Manage hearing proceedings according to the Administrative Hearing Procedures
What We Do Not Do
Administrative Hearings are not court trials and we are not a criminal or civil hearing space. Courtroom evidence rules do not apply, and the hearing process is not adversarial.
We Do Not:
- Provide legal advice
- Determine which cases are sent to our office
- Investigate complaints or gather evidence prior to a hearing
- Represent complainants, respondents, department representatives, or employees
- Determine or impose disciplinary action/sanctions
- Process, coordinate, or manage appeals of written determinations
- Serve as a general grievance or complaint office
